NGO decides to approach apex court over private school fees

The Non-governmental organisation "Justice for all", which challenged the private schools in the Delhi High Court over fee issues, has now decided to approach the Apex court.

New Delhi: The Non-governmental organisation "Justice for all", which challenged the private schools in the Delhi High Court over fee issues, has now decided to approach the Apex court.

Earlier, the Delhi High Court refused to stay its single-judge order allowing private unaided schools to collect annual and development charges from students for the period after the lockdown ended in the national capital last year. A vacation bench of Justices Rekha Palli and Amit Bansal issued notice and sought response of the Action Committee Unaided Recognised Private Schools, which represents over 450 schools, on the appeals of AAP government, students and 'Justice for all' NGO challenging the single judge’s May 31 order.

The court listed the appeals before the roster bench on July 10. The Delhi government and the students have contended that the single judge's decision was based on incorrect facts and law. The May 31 verdict had quashed two office orders of April and August last year issued by the Directorate of Education (DoE) of the Delhi government forbidding and postponing collection of annual charges and development fees, saying they were "illegal" and "ultra vires" the powers of DoE stipulated under the Delhi School Education (DSE) Act and the Rules.

Speaking to ETV Bharat, 'Justice for all' founder, Shikha Bagga Sharma, said, "The Division Bench of the High Court may have refused to impose the stay, but earlier it was clearly stated in the order of the court that the schools have to give a rebate of 15% in the total annual fee for the session 2020-21. This decision was also extended till the session 2021-22. But it is seen that now private schools are once again pressurizing the parents to deposit arbitrary fees by telling this decision in their favour. Parents need to be aware of their rights and the decision of the court."
