Patna: A senior IAS officer in Bihar and a former Rashtriya Janata Dal (RJD) MLA have been booked for allegedly raping a woman following a court direction, police said on Tuesday. A case under relevant sections of the IPC has been registered at Rupaspur police station in Patna following the order of a court at Danapur, they said.
A civil court ordered the Patna police to register a case against the civil servant Sanjeev Hans and the former RJD MLA Gulab Yadav on a petition filed by the woman complainant who claimed that she was raped at a Delhi hotel in 2021. Both have been charged with provisions of gang raping the woman at gunpoint.
After hearing the petition filed by the victim's lawyer, the Additional Chief Judicial Magistrate (ACJM) of Danapur civil court ordered the registration of a rape case against both of them. The woman's first petition in this regard was thrown out by the civil court which never received the preliminary inquiry report it sought from the Patna police.
The woman then knocked on the doors of the Patna High Court which directed the civil court hear the case afresh while passing strictures on the Patna police for not filing the preliminary inquiry report. It also warned the Patna police against its apathy in the issue.
Amid rehearing, the Patna police investigations revealed that the duo in question was present at the hotel along with the woman at the time of the incident. The legislator lured her with a promise to make her a member of the Women's Commission and raped her at his Patna residence, ANI reported quoting the victim.
"He made a video of her and threatened her not to disobey him as he may leak her intimate video. Later, the MLA called her to Delhi where the IAS officer was waiting for them. Both of them raped her again at gun point, the complainant's advocate said quoting his client. Back then Gulab Yadav was RJD's MLA from the Jhanjharpur assembly and Sanjeev Hans was serving as the IAS officer in Patna.
"The complainant gave several written complaints to the Patna Police in 2021 for registering an FIR but due to the high profile case, the police remained silent and did not take any action. Then she had requested to register an FIR in the court of ACJM of Danapur but it was dismissed there also on the ground that the police have not submitted the reports," the advocate said.
"Now after receiving the orders from Patna High court the ACJM of Danapur Civil Court has ordered to register a rape case against both IAS officer Sanjeev Hans and MLA Gulab Yadav," he added.
