BJP questions speaker's notice to Pilot, rebel Cong MLAs

Absence from a legislature party meeting can't be a ground for disqualification from the state assembly, said Rajasthan BJP chief Satish Poonia raising a question over notices sent to rebel Congress leader Sachin Pilot and his supporter MLAs in this regard. 

Rajasthan Speaker C P Joshi has issued notices to Sachin Pilot and other rebel Congress MLAs after the party sought their disqualification from the state assembly. Sacked Deputy Chief Minister Sachin Pilot and the other MLAs were asked to respond to the notices by Friday, sources said. 

The notices were issued on Tuesday. Congress sources said Pilot and 18 other MLAs had defied a whip and did not attend its legislature party meetings.

Former Rajasthan minister Ramesh Meena on Wednesday hit back at Chief Minister Ashok Gehlot's allegations about horse-trading and asked him how much money was paid to BSP MLAs who switched over to the Congress in his previous tenure. 

Earlier in the day, Gehlot talked tough, accusing former deputy chief minister Sachin Pilot of being directly involved in the alleged horse-trading with the opposition BJP to bring down his government. Meena, who was among those Bahujan Samaj Party (BSP) legislators who made the switch to Congress, said: "The chief minister should honestly tell how much money was paid to us when we joined Congress and left the BSP in the last Congress government."

"He should reveal this if he is claiming that deals worth crores of rupees are happening. We were deceived and promised that our work will be done but that did not happen. But, we worked honestly after joining the Congress and played our role in the Opposition," he said in a video released by Pilot's spokesperson.

He further alleged that Gehlot did not pay attention to their demands and maintained a dictatorial attitude.

BJP vice-president and party’s Rajya Sabha MP from Rajasthan Om Prakash Mathur said that notice issued by house speaker to Congress MLAs is unconstitutional as the whip does not have any effect outside the house.  

"The whip is applicable only on the floor of the house and not outside. Issuing notice to MLAs for being absent from legislative party meetings outside the house does not have anything to do with the house," Mathur said.

He said that Pilot still remains a part of Congress but all 19 of his loyalists may see their tickets being terminated following the notice issued by Congress.  

Poonia also alleged that Gehlot is intimidating independent MLAs and other supporting MLAs to gain a majority in the house. Poonia said that now the role of Assembly Speaker Dr CP Joshi in the current developments also seems suspicious.

Congress general secretary and chief spokesperson Randeep Surjewala says Sachin Pilot should return to the family and discuss grievances inside the party forum.

"Stop using media to convey your message. Return to the Congress family. That will be the way to showcase your determination, loyalty and commitment to the ideology," Surjewala said.  

"If Sachin Pilot doesn't want to join BJP, he should refuse Haryana government's hospitality," Surjewala said.

The reference was to reports that MLAs close to the rebel leaders are holed up in hotels in Gurgaon in Haryana, where the BJP is in power.

He told reporters that Pilot should free the Congress MLAs who are staying in two luxury hotels and under the security of the Haryana police.  

Surjewala said the party leadership spoke to Pilot several times but he and the other Congress MLAs did not come to attend the Congress Legislature Party meetings.

Pilot had been an MP from Dausa constituency in 2004.

A day after the Congress cracked the whip and ousted Sachin Pilot, the party dissolved all working committees, departments and cells of the PCC with immediate effect to pave the way for their reconstitution.

A notice has been issued to all rebel MLAs for skipping two Congress Legislative Party meet. According to reports, if the PIlot camp MLAs refuse to reply to the notice, it might invite further disciplinary action.

A similar notice was seen pasted outside MLA Indraj Gurjar. The notice states that under Article 191(2) of the 10th schedule the member could be ousted from the party.

"An elected member of a House who has been elected as such otherwise than as a candidate set up by any political party shall be disqualified for being a member of the House if he joins any political party after such election," the article reads.

"If they don't respond within 2 days, then it will be considered that they are withdrawing their membership from CLP," said Rajasthan Congress in-charge Avinash Pande.

However, the MLAs have the right to move the court in case they are ousted from the party. Pilot who was sacked on Tuesday as both PCC chief and deputy CM for leading the rebellion against the leadership of Ashok Gehlot.

Rajasthan Chief Minister Ashok Gehlot on Wednesday accused rebel Congress leader Sachin Pilot of involvement in horse trading with the BJP. Pilot was removed from the posts of the Rajasthan deputy chief minister and the state Congress president on Tuesday amid a power tussle with Gehlot.  

In an interaction with reporters here, the chief minister, however, did not mention Pilot by his name but said the "former Pradesh Congress Committee president" was himself doing the deal.  

Gehlot said he has the proof that horse trading was being committed to topple his government.

Those who are giving clarifications were themselves involved in horse trading, Gehlot told reporters.

The CM said he (Pilot) would have performed quite good had he "struggled in his youth".

"I have been in politics for 40 years, we love the new generation, the future will be theirs. This new generation, they have become central ministers, state presidents if they had gone through what we did in our time, they would have understood," said  Gehlot.

Gehlot also hit out at the national media saying it is supporting those who are involved in murdering democracy".

With Jyotiraditya Scindia parting ways with the Congress and Sachin Pilot ousted as Rajasthan Deputy Chief Minister and PCC chief, senior Congress leader BK Hariprasad has lashed out at them and dubbed them "careerist politicians who had nothing to do with ideology".

"These so-called young politicians are here to make careers (in politics) but don't have any inclination towards any party ideology," Hari Prasad said.

Hariprasad is a former Congress General Secretary who was in charge of Rajasthan and Madhya Pradesh affairs of the party.

"Ditching the party when the country is facing a serious problem is very unfortunate. No doubt, both Scindia and Pilot are talented, but their loyalty has been for the chair (power) and not for the party or its ideology," he added.

He recalled that in 1998 when Ashok Gehlot was the Congress state unit President, then party stalwarts like Hardev Joshi, Natwar Singh, Shiv Charan Mathur, and Parasram Madrena had accepted Gehlot to be the Chief Minister as the majority of MLAs supported Gehlot.

"The same thing happened in 2018 too after the Assembly elections. Even Nawal Kishore Sharma did not rebel because all those leaders were with the party for a cause," the Congress leader remarked.

Congress' doors have not closed for Pilot: party gen secretary Pande

The Congress' doors have not closed for Sachin Pilot, the party's national general secretary and Rajasthan in-charge Avinash Pande said on Wednesday, a day after the rebel leader was removed as state deputy chief minister.

Pilot has said he worked very hard to bring the Congress back in power in Rajasthan and clarified that he is not joining the BJP.          

"The party''s doors have not been closed for Pilot. May God give... good sense and he realises his mistake. I pray that he comes out of the elusive trap of BJP," Pande said in a tweet.

Notice issued to Pilot, 18 loyalists on grounds of indiscipline; all PCC panels dissolved

A day after the Congress cracked the whip and ousted Rajasthan PCC chief Sachin Pilot, the party on Wednesday dissolved all working committees, departments and cells of the PCC with immediate effect to pave the way for their reconstitution.

All India Congress Committee General Secretary in-charge Avinash Pandey, who issued the orders to this effect, said that since new Pradesh Congress Committee chief Govind Singh Dotasara has been appointed, the new working committees, cells and departments will be set up in consultations with him.

No Congress leader shall talk to the media without the permission of Dotasara, he said.

Meanwhile, the opposition party issued notices to 19 rebel MLAs along with Pilot for allegedly flouting the party whip and not attending Congress meetings called on Monday and Tuesday and asked them to reply within two days.

Part whip Mahesh Joshi issued the notice to the rebel party members.

"If they don't respond within 2 days, then it will be considered that they are withdrawing their membership from CLP," said Rajasthan Congress in-charge Avinash Pande.

However, the MLAs have the right to move the court in case they are ousted from the party.

Pilot who was sacked on Tuesday as both PCC chief and deputy CM for leading the rebellion against the leadership of Ashok Gehlot.

'I'm not joining BJP'

Former Rajasthan Deputy Chief Minister Sachin Pilot on Wednesday said that he is 'not' joining the Bharatiya Janata Party (BJP).

"I am not joining BJP," said Pilot in a telephonic conversation with a news agency.

The comments came a day after he was sacked as Rajasthan Deputy Chief Minister and Pradesh Congress Committee chief by the party.    

The decision to sack Pilot was taken yesterday after a CLP meeting at the Fairmont Hotel in Jaipur, Rajasthan.

At the meeting, as many as 102 MLAs unanimously demanded that Pilot should be removed from the party.

Jaipur: The Congress on Tuesday cracked down on Sachin Pilot, stripping the dissident leader of the posts of Rajasthan's deputy chief minister and the party's state unit president and sacking two loyalists from the state Cabinet.

Though the party seems to have the numbers, for now, to hang on to power in Rajasthan, the development deepens the crisis in the Congress which has lost two major states Karnataka and Madhya Pradesh over the past year.

Ministers Vishvendra Singh and Ramesh Meena were also removed from the Cabinet after a meeting of the Congress Legislature Party, its second in the last two days.

The meeting was billed as a second chance for Pilot, who had turned down appeals from the party's top leadership including Rahul Gandhi and Priyanka Gandhi -- to return to the fold.

Pilot has been upset since the Congress picked Ashok Gehlot as the chief minister after the 2018 assembly polls, while his own supporters insisted that he deserved credit for the party's victory as its state unit president.

His next move is not immediately clear. During the run-up to Tuesday's CLP meeting, his supporters insisted that he had no plans to join the Bharatiya Janata Party. They said their aim was a leadership change in Rajasthan.

"Truth can be rattled, not defeated," Pilot tweeted in Hindi soon after he was sacked.

Gehlot accused his former deputy of playing into the hands of the BJP. "I am very sad that horse-trading was going on," he said.

He also alleged that the BJP wanted to repeat what it had done in Madhya Pradesh.

Pilot had kept away from the first CLP meeting on Monday and sources said 18 other Congress MLAs had also skipped it, giving an indication of the dissident leader's strength.

A video clip circulated by the Pilot camp appeared to show a group of 16 Congress MLAs. In a statement issued Sunday, Pilot had claimed the support of 30 Congress MLAs and some independents.

The numbers are large enough to keep the Gehlot camp on edge, even if most of the 107 Congress MLAs and independents have expressed confidence in his leadership.

The state assembly has 200 MLAs and those close to Pilot are already calling for a test of strength on the floor of the House.

As soon as the meeting ended, AICC spokesperson Randeep Surjewala announced the sacking of Pilot and the two ministers close to him from their posts.

He said Pilot enjoyed the blessings of Congress president Sonia Gandhi and was given political power at a young age. Yet, he and other ministers were trying to topple the state government as part of a BJP conspiracy.

"This cannot be acceptable to any political party. Therefore, the Congress took the decision with a heavy heart, he said.

Education Minister Govind Singh Dotasara, a leader from the Other Backward Classes (OBC) is the new Pradesh Congress Committee (PCC) chief.

Tribal leader and MLA Ganesh Ghogra was appointed the new president of the state Youth Congress, a post held so far Pilot loyalist Mukesh Bhakar. Hem Singh Shekhawat replaced another Pilot supporter, MLA Rakesh Pareek, as the state president of the Congress Sewa Dal.

Abhimanyu Poonia, the president of the state unit of the National Students Union of India (NSUI), resigned.

"We cannot work with a chief minister who has worked to send heads of Jat and Bishnoi families to jail. Our honesty and conscience is still alive," he said on Twitter.

Ashok Gehlot met Governor Kalraj Mishra immediately after the CLP meeting, recommending the removal of the three ministers from his Cabinet.

He also chaired two ministerial meetings at his home that of the senior ministers who for the state Cabinet, and another of the ministers of the state -- where the recent developments were discussed and administrative decisions are taken.

The ministers, like other Congress MLAs in the Gehlot camp, were holed up at a resort on the outskirts of the city since Monday.

Police were put on alert across the state against any fallout of the political developments.

The BJP accused Gehlot of putting the blame for the crisis on the opposition.

"Dear Ashok Gehlot, closing your eyes does not make the sun disappear. There is weakness in the structure of your house, and you are blaming the BJP national leadership for this," party vice president Om Prakash Mathur said.

Ahead of Tuesday's meeting, Congress general secretary Avinash Pande had made another bid to reach out to the rebel leader.

"I appeal to Sachin Pilot and all his fellow MLAs to join today's Legislature Party meeting, Pande, who is the Rajasthan in-charge at the AICC, tweeted.

The Congress has 107 MLAs and the BJP 72 in the 200-member assembly.

In the past, the ruling party has claimed the support of 13 independents, two MLAs each from the CPM and the Bhartiya Tribal Party (BTP), and one from the Rashtriya Lok Dal (RLD).

But CPM and BTP have now indicated that their MLAs could stay neutral till the Congress settles its factional feud.

The current crisis erupted last Friday when the Rajasthan Police sent a notice to Pilot, asking him to record his statement over the alleged bid to bring down the government.

The same notice was sent to the chief minister and some other MLAs, but Pilot's supporters claimed that it was only meant to humiliate him.

The Special Operation Group (SOG) had sent out the notices after tapping a phone conversation between two men, who were allegedly discussing the fall of the Gehlot government.
