Dilution of SC/ST Act: SC amends its own verdict

The Supreme Court has partially allowed to review petitions. The SC has quashed two provisions from the 2018 judgment. On the other hand, the court upheld the anticipatory bail provision.

The Court partially recalled its own order which forbade automatic arrest in cases under SC/ST Act


The apex court has set aside three provisions. The court has said that no preliminary investigation is necessary in these provisions.

The Supreme Court recalled directions which mandated prior sanction for arrest of public servants and private persons. It also did away with requirement of preliminary enquiry before registering FIR.

Dilution of SC/ST Act: SC amends its own verdict

New Delhi: The Supreme Court on Tuesday recalled its own verdict which forbade automatic arrest in cases under SC/ST Act, which diluted the provisions of the act.

A bench of justices Arun Mishra, M R Shah and B R Gavai said the struggle of SC/ST people for equality is still not over in the country. The apex court had allowed the Centre's petition seeking a review of 2018 judgement.

The bench said SC/ST people still face untouchability, abuse and are being socially outcast.

The Supreme Court 2018 verdict passed last year set in place guidelines to prevent misuse of SC/ST Act and by which automatic arrest on complaint filed under the act was stopped. 

The court has recalled directions which mandated prior sanction for arrest of public servants and private persons. It also did away with the requirement of preliminary enquiry before registering FIR.

The Centre had moved a petition seeking review of verdict, forbidding an arrest without prior permission for offences under SC/ST Act 1989.

The SC said the struggle of SC/ST’s for equality & civil rights was still not over. They  are still discriminated. court also said untouchability has not vanished and rued that those involved in scavenging had still not been provided modern facilities.
